Welcome to ContextCaptions ("the Service"). By accessing or using ContextCaptions, you agree to comply with and be bound by the following Terms of Use ("Terms"). Please read these Terms carefully before using the Service. If you do not agree with these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account, purchasing credits, or uploading documents to ContextCaptions, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Service Description

ContextCaptions is an AI-powered document processing service that automatically matches uploaded images to relevant sections of your technical reports and generates contextual captions. The Service accepts DOCX documents and JPG/PNG images as input and provides a processed DOCX file as output.

3. Credit System and Payments

Credit Purchase: The Service operates on a credit-based system. Each document processing requires 1 credit, regardless of the number of images included.

Non-Refundable: All credit purchases are final and non-refundable. Credits cannot be exchanged for cash or refunded under any circumstances.

No Expiration: Credits never expire and remain in your account until used.

Payment Processing: All payments are processed securely through Stripe. We do not store your credit card information.

4. AI Processing and Accuracy

No Guarantees: While our AI technology is highly accurate, we do not guarantee perfect image placement or caption generation. The Service uses artificial intelligence which may occasionally produce errors or unexpected results.

User Responsibility: You are solely responsible for reviewing and verifying all AI-generated content before using it in professional or critical applications. We recommend that you always review the processed document and make any necessary adjustments.

Processing Failures: In rare cases, document processing may fail due to technical issues, unsupported formats, or AI limitations. Credits are deducted only upon successful completion of document processing.

5. User Content and Ownership

Your Content: You retain all ownership rights to the documents and images you upload to ContextCaptions. We do not claim any ownership of your content.

License to Process: By uploading content, you grant us a limited, non-exclusive license to process your documents and images using AI services for the purpose of providing the Service.

Content Deletion: You may delete your documents at any time from your account dashboard. Deleted content is permanently removed from our servers.

6. Prohibited Uses

You agree not to:

  • Upload documents containing illegal, harmful, or offensive content
  • Attempt to reverse engineer, decompile, or extract the AI models or algorithms
  • Use the Service to process documents you do not have the right to use
  • Abuse the Service through automated uploads or excessive usage that impacts system performance
  • Share your account credentials with others

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTEXTCAPTIONS AND ITS CREATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • Errors in AI-generated captions or image placements
  • Loss of data or documents
  • Business losses or professional damages resulting from use of processed documents
  • Service interruptions or downtime

8. Intellectual Property

The ContextCaptions platform, including its design, code, algorithms, and branding, is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on the Service without prior written consent.

9. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspected fraudulent activity, or any other reason at our sole discretion. Upon termination, any remaining credits in your account will be forfeited without refund.

10. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service after modifications constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the appropriate courts.
